My thoughts:

The Churches forbids the mention of 'Equality' as do the Republican party. I see Republican politicians belong to them.

I see Boehner works for the Vatican gov. He wants to give them total control over our nation as those 'churches' are nothing more than political franchise corporations. Jesus never used force...why does the pope want to? Clearly Catholicism is not for GOD. Those who are not for us are against us...I strongly suggest those women who are members of catholic churches read Revelation in their bible. In the end days that we are always supposed to be ready for even the elect shall be deceived. They appear to be the wicked religion of FORCE that wants to control the world. Catholicism means: Universal. And they want to rule it.

Looking at the whole picture there are many other churches that are no different than the Catholic ones. Those who have corporation licenses for Non-profit avoidance of taxes are heathens who are lying about representing GOD when they lust for money and power and make Him look by their 'superior' attitudes And care not for the harm they want to impose on people who do not belong to their church and don't believe in their harmful religious 'opinions' of force.

That in itself is Religious intolerance and acts of treason and anti-Americanism in our nation today.

Just as one of our biggest crooks boasted on media everywhere was a quote from the bible: "Those who are not for us; are against us."

It is very harmful to a whole system when harm is allowed even encouraged toward us who are the REAL Christians.

Those who laugh last laughs best. And it's not over yet. I get the feeling they have been allowed to laugh at the poor, sick, and the children long enough. GOD has a point when He has had enough and His wrath comes to rest on those who blaspheme and make a mockery of Him and His son, Jesus.

I must keep asking these corporate churches: "Where is your Love?"

They seem not to know that one of the ingredients in Love is respect for your neighbors as they seem to demand for themselves.

Truly, if they gain enough power to force Jews to convert to their 'churches', that could be the last straw with GOD.

Is history repeating itself?

PAPAL STRATEGY&CHILD ABUSE-9 --This continues and completes my 8 comments above on Papal Strategy. The current Papal Strategy, as indicated in my 8 comments above, is now evidentally clear, even though the Vatican so far has managed to keep its abusive priest files secret and to shield the pope and relevant Curial decision makers from direct questions from determined journalists. The Vatican press officer, Fr. Lombardi, gets his information only through Curial intermediaries. He does not speak directly to the pope. This evasionary approach is unheard of in other government and corporate press offices. Presumably, the pope's outside lawyers have cautioned him to avoid making any statements to anyone that may later be used in a criminal prosecution. Similarly, in the US most bishops avoid speaking to the press unless it is a carefully controlled interview with a "friendly" reporter who provides his questions in advance. This papal strategy is reinforced with doctrinal positions and liturgical approaches that emphasize the uniqueness and high status of clerics, the lower status of the laity and the purported mystical quality of the pope--almost a form of "popalatry". Ecumenical efforts are in effect at a standstill. They were in many ways victim of their own success. The more these efforts established that other religions offered valid modes of worship, the more they made it easier for disenchanted Catholics to switch to them. Ironically, the abuse scandal has enhanced the Vatican's control over clerics, especially bishops, since Benard Law showed it is the legal sanctuary of last resort. The papal strategy is now pretty evident. Move the Church steadily toward a smaller, tightly controlled, organization with a supreme papal monarch and elevated Curia, obedient clerics and a docile laity. Unlike for-profit corporations that need ever increasing revenues to increase their earnings per share and stock prices, the hierarchy just needs enough money to provide a comfortable lifestyle for bishops, basic support for priests and enough left over to pay their skyrocketing legal expenses. If cash is tight in a particular diocese, expenses can be reduced by closing parishes and schools and selling other non-essential Church property. Financially, this will work so long as docile Catholics keep contributing and legal expenses do not bankrupt too many dioceses. A significant portion of the hierarchy's funding comes from very wealthy Catholics who like to socialize with bishops. For example, Cardinal Levada will speak in a few weeks at Ave Maria University which is funded mainly by Pizza Hut's founder, a major financial supporter of the Vatican and American bishops. These wealthy Catholics to date have made few demands on the bishops to reform the Church and are unlikely to do so anytime soon. Many of them like the bishops' support for Republicans who keep these contributors' income taxes low. The Republicans then every four years make mostly unkept promises on social value issues that reinforce the bishops' rigid sexual doctrines. In return, these political leaders keep the prosecutors away from the bishops and reject laws that would increase civil liabilities or criminal penalties for sexually abusing children. Many Democrats have a similar approach, and will not stand up, to the bishops, even to protect defenseless children. Given the Democrats social values platform, the Democrats cannot ever hope to get the bishops' overt support, but do hope at least to avoid their public opposition. To date the abuse scandal mainly has cost the US Church over $10 billion dollars--$3 billion in legal and settlement costs and over $7 billion in lost contributions over time from the more than 30 million US Catholics that have left the Church. The more important statistic is the more than 100,000 Catholics personally suffering because of this rampant sexual abuse. This includes reported victims, projected unreported victims and their families and loved ones. Most of the victims were young children who were taught to view a priest as God on earth, to be completely trusted. Will the current papal stategy succeed? Certainly not. As the totalitarian regimes in Wojtyla's Poland and in Ratzinger's Germany failed, so will the papal monarchy. While the Vatican now is free of invasions by more powerful European monarchs and has at present complete control of its bishops, its current strategy will not survive the relentless rule of law that is increasingly moving in on the hierarchy and even on powerful priest abusers. In Philly, two Cardinals are at legal risk. In Belgium, the longest serving bishop is at legal risk. The pope is currently under charges before the prosecutor for the International Criminal Court. In Chile a powerful priest is under investigation and the prosecutor just seized all his lawyers' files, including records relating to recent canon law proceedings in Rome. In Ireland Judge Murphy's report through 2009 of the sexual abuses in Cloyne (Cork) is about to be released. The Cork bishop, John Magee, was a long time personal secretary to Montini and Wojtyla. After seven years of service, Wojtyla inexplicably exiled him to a minor Irish diocese. Magee spent twenty years on the papal staff working alongside Riglai. They both appear to have learned the Vatican's management style of secrecy and unaccountability. Rigali was Archbishop Dolan's episcopal mentor in St. Louis and presumably gave him some papal management lessons. Whether Magee will be the first Irish bishop to face a criminal prosecuton is uncertain. There is a new Irish government that does not appear hesitant to take on the Irish bishops. With this current papal strategy, what are Catholics' options? Catholics can continue with the Church, but cease contributions to bishops and keep close tabs on their young children. They can switch to safer Christian denominations as millions of other Catholics already have. They can try to take legal control of their parishes from their bishops as more and more Catholics are already doing. They can also ratchet up the pressure by public demonstrations against their bishops and personal protests to their local priests. If, as appears inevitable, some in the hierarchy are convicted and imprisoned in due course, some bishops may speak out since it will then become clear that not even unlimited funds for lawyers can protect them. That is it from me for now. As a cradle Catholic son of Irish immigrants, I have found writing these comments painful at times. With 16 years of Catholic school education before attending Harvard Law School, I knew some very good Sisters of St. Joseph, Christian Brothers and Dominican priests. I also knew some bad ones. The good ones need our continued respect and support, but they all must speak out forcefully and often as well. The high level of abuse could not have occurred without many, many other clerics taking notice of it and looking the other way. This too must end. I am now retired with six grandchildren, four in the Philly area. I want my grandchildren to be able to approach our God safely. I want abuse victims comforted, respected and compensated. I want criminal clerics fully prosecuted. I want good clerics supported. The Church must change and it will. The current papal strategy is doomed to fail. Have a blessed Easter and ask God's help to change our Church, to comfort victims and to forgive the contrite among us for our failures in letting this abuse debacle go on for so long. Pax.

(I pray this issue is put to rest and justice reigns in GOD'S name once again in America.)

"Hmm...maybe so...but on further thoughts; at the beginning of legalization those guys could get some public respect. And it COULD be an advantage to we poor as the big rich hoodlums who get scott-free with murders, there could be a battle between THEM and the new rich businessmen....? I mean, I know they fight each other for 'customers' who take their money away. (alcohol and weed?) Before alcohol was legal in Okla. which was still a territory, the bar owners would end up killing their competition when they went into the same business. In fact, I almost got my ass kicked and banned from a bar once 'cause I went there for awhile, me and a friend and then decided to leave and going down the road decided to go to a nightclub wayyy out of town. Well, ended up a bunch of customers in the bar went out to the same club and the bar owner's waittress told her boss I took them out to the nite club!! Now way! That little witch lied, SHE was the one who talked them into it.But fortunately there were a group of people there the same nite and told me what was happening and they knew I didn't do it! Thank GOD I got an apology out of that! Those business people can be awful mean and vengeful. I'm not joking. But wouldn't it be better to pit those big fighting cocks against each other? :)"

Sky Light Coming Closer

This is closer than it's ever been. I think they were giving me permission to take this vid. It was moving around but my hands were pretty steady as I had my elbows on a container to steady this. The pictures included I took as close as possible with my cam and then enlarged on program, crop in another to enlarge them as much as possible. Pretty astounding to me. Pretty colors. I like them. Is this space aliens or a satellite? Wouldn't it be too close as a satellite? Plus, the way it moves around so quickly? How could I find out? Suggestions plz?

Quantum objects
Remarkably, there exists a realm of physics for which mathematical assertions of simple symmetries in real objects cease to be approximations. That is the domain of quantum physics, which for the most part is the physics of very small, very simple objects such as electrons, protons, light, and atoms.
Unlike everyday objects, objects such as electrons have very limited numbers of configurations, called states, in which they can exist. This means that when symmetry operations such as exchanging the positions of components are applied to them, the resulting new configurations often cannot be distinguished from the originals no matter how diligent an observer is. Consequently, for sufficiently small and simple objects the generic mathematical symmetry assertion F(x) = x ceases to be approximate, and instead becomes an experimentally precise and accurate description of the situation in the real world.
Consequences of quantum symmetry
While it makes sense that symmetries could become exact when applied to very simple objects, the immediate intuition is that such a detail should not affect the physics of such objects in any significant way. This is in part because it is very difficult to view the concept of exact similarity as physically meaningful. Our mental picture of such situations is invariably the same one we use for large objects: We picture objects or configurations that are very, very similar, but for which if we could "look closer" we would still be able to tell the difference.
However, the assumption that exact symmetries in very small objects should not make any difference in their physics was discovered in the early 1900s to be spectacularly incorrect. The situation was succinctly summarized by Richard Feynman in the direct transcripts of his Feynman Lectures on Physics, Volume III, Section 3.4, Identical particles. (Unfortunately, the quote was edited out of the printed version of the same lecture.)
"... if there is a physical situation in which it is impossible to tell which way it happened, it always interferes; it never fails."
The word "interferes" in this context is a quick way of saying that such objects fall under the rules of quantum mechanics, in which they behave more like waves that interfere than like everyday large objects.
In short, when an object becomes so simple that a symmetry assertion of the form F(x) = x becomes an exact statement of experimentally verifiable sameness, x ceases to follow the rules of classical physics and must instead be modeled using the more complex—and often far less intuitive—rules of quantum physics.
This transition also provides an important insight into why the mathematics of symmetry are so deeply intertwined with those of quantum mechanics. When physical systems make the transition from symmetries that are approximate to ones that are exact, the mathematical expressions of those symmetries cease to be approximations and are transformed into precise definitions of the underlying nature of the objects. From that point on, the correlation of such objects to their mathematical descriptions becomes so close that it is difficult to separate the two.

Keep coming down to the drive that is dangerous because you can't see around it until our people get to the street. I am NOT watching other people's kids! Called police at 7:20, woman on 911 hateful and slammed the phone down on me. Police DIDN'T even check to see if their mother was HOME! Just told the kids to stay out of the drive. They took white people's kids when little but pay these NO MIND! Or is this proof they ignore those who appear to be mexican citizens??? And don't people still sue anyone who owns property they come on and get hurt? Do they hate their kids and don't give dam?

To avoid the abuses of the English law (including executions by Henry VIII of those who criticized his repeated marriages), treason was specifically defined in the United States Constitution, the only crime so defined. Article III Section 3 delineates treason as follows:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

However, Congress has, at times, passed statutes creating related offenses which undermine the government or the national security, such as sedition in the 1798 Alien and Sedition Acts, or espionage and sedition in the 1917 Espionage Act, which do not require the testimony of two witnesses and have a much broader definition than Article Three treason. For example, some well-known spies have been convicted of espionage rather than treason.

The Constitution does not itself create the offense; it only restricts the definition (the first paragraph), permits Congress to create the offense, and restricts any punishment for treason to only the convicted (the second paragraph). The crime is prohibited by legislation passed by Congress. Therefore the United States Code at 18 U.S.C. § 2381 states "whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States." The requirement of testimony of two witnesses was inherited from the British Treason Act 1695 (Since 1945, however, this has been abolished in British law and treason cases are now subject to the same rules of evidence and procedure as a murder trial, but the US requirement still stands barring an amendment).

In the history of the United States there have been fewer than 40 federal prosecutions for treason and even fewer convictions. Several men were convicted of treason in connection with the 1794 Whiskey Rebellion but were pardoned by President George Washington. One of American history's most notorious traitors, in which his name is considered synonymous with the definition of traitor, is Benedict Arnold. The most famous treason trial, that of Aaron Burr in 1807 (See Burr conspiracy), resulted in acquittal. Politically motivated attempts to convict opponents of the Jeffersonian Embargo Acts and the Fugitive Slave Law of 1850 all failed. Most states have provisions in their constitutions or statutes similar to those in the U.S. Constitution. There have been only two successful prosecutions for treason on the state level, that of Thomas Dorr in Rhode Island and that of John Brown in Virginia.

After the American Civil War, no person involved with the Confederate States of America was tried for treason, though a number of leading Confederates (including Jefferson Davis and Robert E. Lee) were indicted. Those who had been indicted received a blanket amnesty issued by President Andrew Johnson as he left office in 1869. The Cold War saw frequent associations between treason and support for (or insufficient hostility toward) Communist-backed causes. The most memorable of these came from Senator Joseph McCarthy, who characterized the Franklin Delano Roosevelt and Harry Truman administrations as "twenty years of treason." McCarthy also investigated various government agencies for Soviet spy rings; however, he acted as a political fact-finder rather than criminal prosecutor. The Cold War period saw few prosecutions for treason. On October 11, 2006, a federal grand jury issued the first indictment for treason against the United States since 1952, charging Adam Yahiye Gadahn for videos in which he appeared as a spokesman for al-Qaeda and threatened attacks on American soil.

United States: A Renewed Emphasis On Upjohn Warnings

As white-collar government investigations and enforcement actions increase in the wake of the recent financial crisis, so too do the challenges for attorneys engaged in corporate internal investigations. Specifically, lawyers face potential conflict-of-interest issues in connection with these investigations and may run afoul of ethics rules and risk penalties by failing to take adequate steps to protect themselves.

For example, several recent cases have involved allegations of attorneys' failure to appropriately handle and disclose conflicts of interest when representing company employees in connection with internal investigations or inquiries from government regulators. As a result, there has been an increased focus on so-called Upjohn warnings (otherwise known as the "corporate Miranda") that company counsel provides to company employees in connection with these investigations. While these recent cases have more to say about traditional conflict-of-interest concerns than Upjohn warnings, it is important for practitioners to be mindful of the potential ethical pitfalls surrounding each.

The Upjohn Warning
The so-called Upjohn warning takes its name from the seminal Supreme Court case Upjohn Co. v. United States,1 in which the court held that communications between company counsel and employees of the company are privileged, but the privilege is owned by the company and not the individual employee. Thus, in an internal investigation, the company is the client and therefore controls privilege. The purpose of the warning is to remove any doubt that the lawyer speaking to the employee represents the company, and not the employee.

A typical Upjohn warning consists of an explanation that the lawyer represents the company, not the individual. Therefore, anything revealed during the course of the interview is only privileged as between the lawyer and the company. The employee has no control over whether the company decides to waive the privilege, which often may be done sometime in the future in the hope of obtaining cooperation credit from the government.2

Clearly then, this presents a potentially difficult situation for a practitioner. It is in the best interest of the company and outside counsel to encourage employees to be candid and forthcoming during the course of an investigation. However, at the same time, a proper Upjohn warning makes it clear that employees' statements are not within their own control, as the company has the right to waive the privilege and disclose these statements to the government, and thus could make employees less likely to reveal potentially incriminating facts.

Also, this creates the possibility that practitioners might give an unclear or incomplete Upjohn warning. Even experienced businesspeople may not appreciate the nuances of privilege, and the risk looms far greater with less sophisticated employees who are given an unclear Upjohn warning.

Two highly publicized cases from earlier this year highlight the issues facing attorneys conducting internal investigations, including the ethical challenges arising from interviews of company employees.

Broadcom: A Study in Potential Conflict Of Interest
In connection with the pending criminal case against senior management of Broadcom Corp., a law firm in Los Angeles suffered the ire of U.S. District Judge Cormac J. Carney for "breach[ing] its duty of loyalty" to its client, former Broadcom CFO William Reuhle.3 In April Judge Carney issued a scathing opinion on the ethics of multiple representations, finding that the law firm's actions created a conflict of interest that no Upjohn warning could salvage. As a result, Judge Carney suppressed Reuhle's statements and even went so far as to refer the law firm to the California State Bar for discipline.

Broadcom retained the firm in 2006, when the government began investigating the company in connection with its stock option practices. As a result, the law firm began conducting an internal investigation into alleged stock option backdating at Broadcom. At the same time, Broadcom was sued in two separate civil actions related to the same issues, and Reuhle was individually named in both actions, where the same law firm represented him for the first several months of the proceedings.

Simultaneously, as part of the internal investigation, the law firm interviewed Reuhle. At the beginning of the interview, Reuhle supposedly was told only that the investigation was being done "on behalf of Broadcom." Subsequently, and apparently without Reuhle's consent, Broadcom agreed to turn over his interview statements to the U.S. attorney, and Reuhle later was indicted on a variety of criminal charges in June 2008. Reuhle then filed a motion to suppress his statements made to company counsel, arguing that his rights under Upjohn had been violated.

In his April 1 decision Judge Carney lambasted the law firm for failing to provide a proper Upjohn warning to Reuhle, rejecting the suggestion that a statement that the interview was done "on behalf of Broadcom" was sufficient. The judge criticized the attorneys' failure to explain that they were representing Broadcom's interest in the interview, rather than Reuhle's, and that any information disclosed could be used by Broadcom or disclosed to the government.

Indeed, Judge Carney found that Reuhle had a very legitimate reason to believe that the law firm represented his personal interests, as the firm had been representing him in civil litigation related to the identical subject matter as the internal investigation. According to Judge Carney, California disciplinary rules mandate that any simultaneous representation presenting conflicting interests requires written consent by both parties — something the law firm apparently never obtained.4

The judge found that the law firm violated its duty of loyalty to Reuhle because:

It questioned him for the benefit of a separate client, Broadcom; and
It did not consult Reuhle before disclosing his statements to third parties, particularly the government.
According to Judge Carney, the firm should have informed Reuhle that it might be in his best interest to pursue separate counsel.

This recent decision presents the practitioner with several instructive lessons. First, it is essential that very early in any internal investigation, the attorney assesses where potential conflicts of interest might arise. This is particularly true when separate civil suits implicate company executives who may also be witnesses in connection with the internal investigation.

Second, if an attorney does decide to represent both the company and an individual employee, she should obtain a written conflict waiver. Notably, however, even a conflict waiver may not prevent a circumstance where the attorney is forced to resign from both representations, if the conflicts become irreconcilable.

Third, an Upjohn warning is not necessarily a replacement for a conflict waiver, even where the Upjohn warning is full and sufficient.

Finally, when interviewing a company employee, an attorney should always administer a full Upjohn warning and note the fact in writing contemporaneously or memorialize it soon thereafter. A watered-down Upjohn warning may not be sufficient, as demonstrated in the Broadcom case, as well another case from earlier this year.

Stanford Financial Group: Another Study In Potential Conflict of Interest
On the heels of the Bernard Madoff scandal, another alleged Ponzi scheme drama exploded in early 2009 in connection with Stanford Financial Group. According to public reports, the criminal and regulatory investigation into Stanford broke open several days after a New York lawyer made a "noisy withdrawal" from his representation of Stanford before the Securities and Exchange Commission. Specifically, the attorney withdrew his representation from the company and disaffirmed all his prior statements made to the SEC.

Shortly thereafter, Laura Pendergest-Holt, Stanford's former chief investment officer, sued the lawyer and his firm for malpractice involving an alleged breach of the fiduciary duty of loyalty.5 Although Pendergest-Holt later moved to dismiss the action without prejudice, the facts surrounding her malpractice claim again demonstrate the pitfalls for an attorney or law firm that simultaneously represents both a company and its executives.

According to the civil complaint, the lawyer accompanied Pendergest-Holt to her deposition at the SEC Feb. 10. Pendergest-Holt said she believed that the lawyer was her attorney and represented her in an individual capacity. The complaint recounts an alleged conversation at the deposition where the attorney told the SEC staff, "I represent her insofar as she is an officer or director of one of the Stanford affiliated companies." Receiving no further clarification, Pendergest-Holt claims to have believed that this attorney would represent her interests.

However, Pendergest-Holt alleges in her complaint that the attorney failed to serve her interests in several material respects:

He did not inform her of her Fifth Amendment right not to testify and instead allowed her to make statements to the SEC that subsequently led to her indictment on obstruction charges;
He failed to tell her that her conversations with him were not privileged, insofar as the company controlled the privilege;
He did not explain that conflicts of interest existed between Pendergest-Holt and Stanford that would not allow the attorney to simultaneously represent both parties; and
He never advised her that she should seek separate counsel.
If these allegations seem to echo the facts in the Broadcom case, it is because these problems may be far from unusual. If these two recent, highly publicized incidents are any indication, the pendulum may be swinging toward heightened scrutiny of conflicts of interest. As such, the days of the "watered-down" Upjohn warnings could be numbered.

The Days Ahead: Considerations For Practitioners
The possibility of future complications and consequences arising from incomplete or unclear Upjohn warnings prompts a number of practical lessons that can be drawn from these two recent cases. First, it is important to assess, very early on in any investigation, which parties will require separate counsel. That counsel should be provided to the company employee promptly, ideally before any substantive information is learned from the witness. Any confidences shared by a witness-client or prospective witness-client may present future conflict issues that could force an attorney to resign from representing both the witness and the company.6 Moreover, if during an interview with an unrepresented witness, a lawyer discovers that the witness has interests that conflict with the interests of the company, the ethics rules require the attorney to advise the witness to secure counsel.7

Second, if an attorney does decide to represent both an individual and the company, she would be prudent to obtain an informed written conflict waiver from each party.8 Even then, the lawyer must reasonably believe she can represent both parties' interests adequately. With that in mind, it is generally good practice to include in any conflict waiver (or retainer agreement), a provision that, in the face of a conflict, allows the attorney to resign from one representation in favor of the other.

Third, when conducting an interview with a company employee, company counsel should administer a complete Upjohn warning. Ideally, the interview preparation materials or some form of written protocol should outline the substance of the warning. Additionally, the administration of the warning should be documented contemporaneously in the interview notes, and it also should be noted that the witness acknowledged that he understood the warning. A properly administered (and memorialized) warning can save an attorney plenty of headaches down the road.

By example, a comprehensive Upjohn warning should include the following statements and explanations, in some form or another:

We represent the company, not you.
As part of our investigation, we need to gather information. We do so by speaking with employees. We gather this information for the purpose of providing legal advice to our client, the company. As such, this means that our conversation with you is protected by the attorney-client privilege.
However, the privilege is between the lawyers and the company, not you. The privilege is controlled by the company, and the company may decide to share any information it learns through this interview with third parties, including the government, without your permission or notice.
Finally, as an employee, we ask that you keep everything discussed here confidential. Please do not share this conversation with anyone, including other employees. This is what keeps the conversation privileged.
An interesting issue arises in the context of in-house representation. In-house counsel represents the company, as opposed to individual employees. The question is when do in-house attorneys need to provide an Upjohn warning to employees. Ultimately, the calculus is very similar to interviews conducted by outside counsel. Generally, the more substantive the interview, the more senior the witness or the more involvement of the employee in question, the greater likelihood that an Upjohn warning is necessary and prudent.

Finally, it is worth noting that while the recent Broadcom and Stanford cases may at first appear to be outliers, the problems they present are common and likely to face any practitioner who engages in an internal investigation and must provide Upjohn warnings when interviewing company employees. Moreover, as the current administration in Washington continues to turn up the heat on enforcement efforts, it is reasonable to expect that internal investigations will become more frequent and these issues surrounding potential conflicts of interest concerning company employees may become more prevalent. As such, it is incumbent upon attorneys to keep in mind the rules of the road concerning Upjohn warnings in order to avoid the ignominy of facing an ethics review board and to help prevent a company employee from unwittingly forfeiting his Fifth Amendment rights.

Rally Aims To Boost MAPS 3 Support

OKLAHOMA CITY -- City leaders worked to build support for the MAPS 3 plan with a rally at Lake Overholser on Sunday.

City leaders want to use a 1-cent sales tax to make improvement to rail lines, build a new downtown park and a convention center. The $40 million plan would also expand current trails to create the nation's longest trail system.

"If MAPS 3 passes, we are going to build a trail all the way around Lake Overholser, a trail all around Draper Lake and connect all three city lakes," said Trails Advisory Committee Chairman Hal McKnight.

"It will be fun. I will probably ride about five miles," said bicyclist Henry Amis, 8.

Organizers also want to include a $60 million project to improve the Oklahoma River and its white water course.

"The river venue, we can be one of the best, if not the best urban aquatic venue in the world," said Oklahoma City University rowing coach Mike Knopp.

The MAPS 3 proposal, if passed, would begin collecting a 1-cent sales tax in April and continue for nearly 8 years.

The Fraternal Order of Police said it opposes the plan, saying that hiring more officers should be a bigger priority. The group asked the Oklahoma City Council to use some of the money from the MAPS-3 plan to promote public safety.

The council is set to vote on the measure on Dec. 8.

INCIDENT AT ALDI’S GROCERY STORE

In the store so many illegals were in the store driving baskets right in front of me and trying to get close enough to touch me. When I finished and ready to leave all the illegals rushed to the only check-out woman to go out. The nun was third one in the only checkout line.
I naturally went to the first empty line to lean and wait for those obnoxious, disrespectful, lawbreaking, bullies to get done so I could leave.
A lady came out to check and smiled at me and said she would check me out. I started over and the nun third in line tore out and came racing saying something nasty about it was HER turn and she worked for illegals and something about it was HER TURN, and I graciously let her go ahead. As she did she started talking about HER HISPANICS and me , and then started talking Spanish and looking at me hatefully.
Her Spanish and hateful tone and looks at me pissed me off and I told her maybe SHE don’t have no legal papers! Finally she paid and walked out. All the lawbreaking illegals surrounded the end of check-out lanes. Apparently they sent that one young illegal taller than my waist running over to me and hit my purse HARD and it hurt my back. Deliberately, clearly. I told him if he hit me again I would call the police. And don’t think I won’t.
Badly the truth must be this: the nun and the Catholic church are obviously breaking man’s laws. Like one, supporting the racist Mexican lawbreakers illegals who HATE Americans. And they must be the group that has had me stalked for so long.
Clearly this church accepts blood money. Laundering illegal’s money for selling illegal drugs. Yet they DO NOT want to support legalizing pot. Cause they don’t like paying taxes for their satanic business deals.
Religiously speaking they are viciously violating GOD’S laws and should have started expecting some of the worst rebuke from GOD they will experience.
They are hating their neighbors here in America. They have been hurting poor American citizens by making state and Federal government give money and programs to illegals that they have been denying poor, suffering, American citizens who it ONLY belongs to.

I can't by any stretch of the imagination consider anyone holy, who would deny those doing what is GOD-given in their 'human' nature and condemn them to their death by with-holding medical and scientific safety devices that can save lives. But that is just what the Pope proposes. And even his own people realizes the futility of such a stance. But still he seeks to dangle the 'church' over people's heads like Damocles sword, because what ELSE could he threatened them with. After all being a mere mortal he cannot take GOD away from someone who loves him, nor can he steal any man from the GOD who loves him in return.

Passive murder as I see it. To see someone kill another person and someone saw it happen but walking away without helping or going to find help and the person dies makes the witness just as guilty as the main murderer. And if our main purpose isn't to improve this life and help others the best we can then it makes Jesus's life and works a joke and that he lied and died. But I don't believe that was the message of his life. And the gift he left to us was humbleness...and few partake in the feast.

Of course we should strive always for perfection, but it was only reached once by one human and that was Christ. And yet he forgives us when we seek it. And that he can see into our hearts and makes lying to him impossible, it is called a 'grace' which makes possible the gift of humbleness. Not by works, but by faith that no man should boast....

Bank of America started as Bank of Italy

Amedeo Giannini, son of Italian immigrants to the US, started the Bank of America in a converted saloon in San Francisco at 9 am on Monday, 17 October 1904. On the first day, 28 deposits totalled $8,780.

When an earthquake struck in 1907, he ran his bank from a plank in the street. Word quickly spread about his service and by 1916 he had several branches. By 1929, the bank was strong enough to withstand the Great Depression stock crash. Giannini changed the name to Bank of America in 1928 and remained chairman until 1963.

The Bank of Italy in Italy was created in 1893 through the merger of 3 of the 6 banks at the time: Banca Nazionale nel Regno d'Italia and 2 Tuscan banks.

The Bank of England was founded by William Patterson after King William III of England found himself badly in need of funds to fight a war with France in 1694. Patterson provided the funds after the king agreed to order all the goldsmiths of London to stop issuing receipts as depositories for precious metals, forcing merchants to store their gold with the new bank. The Bank of England was finally authorised in 1946.

The Reichsbank of Germany was founded by Meyer Amschel Rothschild (1743-1812), who appointed his son Karl over the Bank of Naples, and his son Salomon over the Bank of Vienna. Later, his son Edmund presided over the Bank of Germany,and his son Nathan over the Bank of England.

By the time of the American Civil War (1861 - 1865) there were 1600 banks in the US, issuing about 7,000 different kinds of bank notes.

In 1861, the US Congress authorised "promissory notes," calling them "greenbacks" to contrast in colour with notes issued by private banks. The US Treasury held the impressive sum of $346,681,016. (Link)

In 1958, it invented the bank credit card, the BankAmericard, which changed its name to VISA in 1975. A consortium of other California banks came up with Master Charge (now MasterCard) in order to compete with BankAmericard.

Following passage of the Bank Holding Company Act of 1967, BankAmerica Corp. was established for the purpose of owning Bank of America and its subsidiaries.

BankAmerica expanded outside California in 1983 with its acquisition of Seafirst Corp. of Seattle and its wholly owned banking subsidiary, Seattle-First National Bank. This happened when Seafirst was at risk of being seized by the federal government after becoming insolvent through a series of bad loans to the oil industry. However, BankAmerica continued to operate the banks as Seafirst rather than Bank of America until after the merger with NationsBank.

Bank of America was dealt huge losses in 1986 and 1987 due to bad loans in its Third World lending, particularly in Latin America. The company fired its CEO, Sam Armacost, although Armacost blamed the problems on his predecessor, A.W. (Tom) Clausen, who was then appointed to replace Armacost. The losses resulted in a huge decline of BankAmerica stock, making it vulnerable to a hostile takeover. First Interstate Bancorp of Los Angeles (which had been built from banks once owned by BofA), launched such a bid in the fall of 1986, although BankAmerica rebuffed it, mostly by selling its FinanceAmerica subsidiary to Chrysler and by selling the brokerage firm Charles Schwab and Co. back to Mr. Schwab. On the day of the stock market crash in 1987, BankAmerica was trading at $8 per share, although by 1992 it had rebounded mightily to become one of the biggest gainers of that half-decade.

In 2004, Bank of America Corp. acquired Boston, Massachusetts-based FleetBoston for $47 billion to solidify Bank of America's position as the bank with the largest FDIC rated deposit market share in the United States with $513 billion in deposits well ahead of the number 2 bank holding company, newly-merged J.P. Morgan Chase-Bank One with $353 billion in deposits and number 3 Wells Fargo & Co. with $228 billion. (Deposits as of June 30, 2003.) The combined Bank of America and Fleet have 5,700 branches serving 35 million customers in 29 states. After the merger with FleetBoston Financial, roughly 1 out of every 10 dollars on deposit in a commercial bank and savings and loan were deposits of Bank of America.

The purpose of this organization is to promote the advancement of the commercial and economic interests of Hispanic-owned businesses, Hispanic-managed businesses, and the Hispanic-oriented businesses, trades and professionals in central Oklahoma.
In our five years of existence, the Greater Oklahoma City Hispanic Chamber of Commerce has focused on business development issues. In a new initiative the board has expanded that focus to include a range of community development issues including:

The Greater Oklahoma City Hispanic Chamber of Commerce frequently provides services to the Hispanic community in the form of business training workshops as well as “one on one” counseling through our Business Assistance Center.
Viva Oklahoma is a publication which reaches over 40,000 Hispanic families throughout Oklahoma City and provides information to the community about projects, such as OHLAP.
Viva! Expo, the Chamber’s annual business and consumer expo where over 160 Hispanic and non-Hispanic businesses promote and display products and services. Over 12,000 people attended last year.
Monthly network, “Business after Hours”, for members to network and promote their business and projects. The monthly network is held every third Thursday of the month.
Christmas Gala and award ceremony in December.

Oklahoma City’s Hispanic population is substantial and growing. As the Hispanic community grows it will continue to impact the city’s economy and future:
In 2003 the Hispanic population in Oklahoma City was estimated to be 9.97 percent of the city's population and 5.74 percent of the state’s population.
About one in thirteen children in Oklahoma City are Hispanic and Hispanic students make up the majority in the Oklahoma City Public Schools.
Young Hispanics will be a significant part of Oklahoma's labor force a decade from now on.

According to the 2004 census update, Oklahoma had over 223,000 Hispanic residents. Some 43% (95,890) of those reside in the 10 county greater Oklahoma City area. Most of those (57,336) live in Oklahoma County. The remarkable aspect of Central Oklahoma’s Hispanic population is that a majority of the Hispanic residents of central Oklahoma are concentrated in a real community of neighborhoods in South Oklahoma City.
In the core of the Hispanic community are 30 square miles of neighborhoods and commercial areas where more than 30% of the population is Hispanic. Some neighborhoods approach 70% Hispanic. Adjacent areas encompass approximately an additional 20 square miles where the population is at least 15% Hispanic.
Although these figures were from the 2000 census, we estimate the Oklahoma City metropolitan area Hispanic population exceeds 90,000 and in statewide over 300,000.

Now David Castillo wants to infiltrate an American public office. As an arm of Mexico he will institute racist and discriminatory acts against Americans until we voluntarily 'deport' ourselves in self-defense of the racist, hateful and harmful practices which Mexico uses as a matter of everyday business. Even poor Mexicans who vote for him will be cutting their own throats as they are treated every bit as badly as American workers have been treated for the last few years. Their business people are vicious and cruel taskmasters who pay their own people starvation wages and demand perfection from them; some like Chelino's pay illegals only a dollar an hour and whatever they can get in tips. This is their last gasp attempt to turn this nation into a cheap replicate of Mexico! This is not only Anti-American, it's ANTI-CHRISTIAN! These people are the devil's children and I smell sulfur in the air. DON'T LET THEM TAKE OUR COUNTRY!
